Automation does not remove consumer protections

Housing providers and screening companies may use software, algorithms, or AI as they review applications. The Fair Housing Act still applies when those tools are used. HUD has specifically addressed the risk that automated screening and digital advertising can create unfair housing outcomes.

For a renter, the practical issue is often not the name of the technology. It is whether the record is accurate, whether the next step is clear, and whether you know how to request or challenge the information used in a decision.

If an application is denied or conditions change

The Consumer Financial Protection Bureau explains that when a landlord takes an adverse action because of a tenant-screening report, the applicant should be told that fact and receive information about the company that supplied the report. An adverse action can include a denial, but can also include different conditions such as a co-signer, higher rent, or a larger deposit.

Save the application confirmation, messages, and any notice. Request the report promptly, review each item, and dispute inaccurate or outdated information with the appropriate reporting company. Keep your rental search organized

  1. Ask what documentation is required before paying multiple application fees.
  2. Keep a record of each application and authorization.
  3. Read every notice from the housing provider or screening company.

  5. Use a qualified legal or housing resource for an individual rights question.
